General Terms of Use for the Find a Baker Service

Article 1: Purpose and nature of the service
The Find a Baker service (hereinafter the “Service”) is an online professional directory operated by PATISSLAND, a simplified joint-stock company (SAS) with share capital of €10,000, registered with the Pontoise Trade and Companies Register under number 840 623 235, whose registered office is located at 12 Chaussee Jules Cesar, 95520 Osny, France. The Service connects, on the one hand, individuals or professionals seeking pastry, cake design, or catering services (hereinafter the “Clients”) and, on the other hand, professionals offering such services (hereinafter the “Bakers”).
Patissland acts exclusively as a technical host and passive intermediary. Patissland provides a publishing space and a matchmaking tool. Patissland is neither a party, agent, guarantor, nor commercial intermediary in the relationships and transactions established between a Client and a Baker. Patissland does not provide any pastry services and receives no commission on services performed by Bakers.
Article 2: No liability for the Client-Baker relationship
The contractual relationship resulting from a connection made through the Service is established exclusively between the Client and the Baker. It is independent of Patissland.
Patissland shall not be held liable, on any grounds whatsoever, for:
- the conclusion, performance, non-performance, or improper performance of a service ordered from a Baker;
- the quality, conformity, taste, appearance, or food safety of products made by a Baker;
- quotes, prices, deadlines, terms of sale, or delivery arrangements offered by a Baker;
- any dispute, disagreement, damage, delay, loss, or dissatisfaction arising between a Client and a Baker.
Any dispute relating to a service must be resolved directly between the Client and the Baker concerned. Patissland may not be called upon to guarantee or be held liable in this regard.
Article 3: Relationship with the Client and prevention of unpaid invoices
Just as Patissland does not intervene in a dispute raised by a Client against a Baker, Patissland likewise does not intervene in difficulties that a Baker may encounter because of a Client. The Baker remains solely responsible for managing its commercial relationship with the Client, including collecting payment for its services.
Patissland draws the Baker’s attention to the risks inherent in any made-to-order service business, particularly:
- a Client placing an order and then withdrawing, canceling, or failing to show up;
- a Client failing to pay all or part of the agreed price;
- a Client providing inaccurate information or false contact details;
- a quote request that is not genuine or does not lead to any further action.
As a simple recommendation and without this constituting an obligation, Patissland advises the Baker to secure its services, for example by requesting a deposit when the order is placed, formalizing a signed quote or purchase order specifying the cancellation terms, and clearly defining its payment deadlines and procedures before making any commitment. As a professional, the Baker is responsible for freely determining the measures appropriate to its business. Patissland provides no contractual template, collects no money on behalf of the Baker, and shall not be held liable for an unpaid invoice, cancellation, or loss caused to the Baker by a Client.
Article 4: Obligations and representations of the Baker
By creating a listing, the Baker represents and warrants that it:
- operates a legally declared professional business and has a valid business identification number (SIRET or equivalent, depending on its country);
- is the legitimate holder of the identity, trade name, and information it provides, and does not impersonate another organization, person, or brand;
- holds all authorizations, registrations, insurance policies, and certifications required for its business, particularly regarding food hygiene and compliance with applicable HACCP standards;
- holds the rights to the photographs and content it publishes;
- provides accurate, truthful, and up-to-date information.
The Baker is solely and exclusively responsible for complying with the regulations applicable to its business, particularly rules on hygiene, food safety, HACCP standards, allergen labeling, taxation, and insurance. Patissland does not carry out any substantive review of actual compliance with these obligations and shall not be held liable for any failure by the Baker to comply with any of them.
Article 5: Verification, false declarations, and impersonation
The verification carried out by Patissland before publishing a listing is a formal and plausibility check. Under no circumstances does it constitute certification, approval, accreditation, or a guarantee of the quality, reliability, legality of the business, or accuracy of a Baker’s information.
In the event of false registration, a forged document, impersonation of an existing organization, a false declaration, or fraudulent use of the Service, responsibility lies exclusively with its author. Patissland, which is a victim of such fraud just as third parties are, shall not be held liable for it. Patissland reserves the right to suspend or delete any listing without prior notice in the event of doubt, a report, or a breach, and to provide the competent authorities with any useful information in the event of fraudulent conduct.
Article 6: Content removal and reporting
In accordance with its status as a host, Patissland promptly removes any manifestly unlawful content reported to it. Any Client, Baker, or third party may report a listing or disputed content at info@patissland.fr. The Baker may request the modification or deletion of its listing at any time at the same address.
Article 7: Free service and changes to the service
The Service is offered free of charge at launch. Patissland reserves the right to change the Service, its features, and its terms at any time and without prior notice, including its financial terms. The applicable terms are those published on this page; the Baker is responsible for reviewing them regularly. The Baker may request the removal of its listing at any time under the conditions set out in Article 6.
Article 8: Personal data
The processing of personal data collected in connection with the Service is governed by Patissland’s Privacy Policy, available at patissland.fr/policies/privacy-policy. The Baker’s private contact details, particularly its telephone number, are not published and are used solely to manage its listing and forward quote requests.
Article 9: General limitation of liability
Patissland uses reasonable means to ensure the availability of the Service without guaranteeing uninterrupted access. Patissland shall not be held liable for any interruption, unavailability, data loss, or indirect damage related to the use of or inability to use the Service.
Article 10: Governing law
These terms are governed by French law. Any dispute relating to their interpretation or performance shall fall under the jurisdiction of the French courts, subject to mandatory legal provisions applicable to consumers.
