General Terms of Use
of the Find an Artisan service

These terms govern the publication of professional listings in the Find an Artisan directory and the transmission of quote requests. They apply both to listed artisans and to the clients who contact them. Patissland is neither the seller nor the service provider, and does not guarantee the services provided by the artisans.

Article 1: Publisher Identification

The Find an Artisan service, hereinafter the Service, is published by PATISSLAND, a simplified joint-stock company with capital of €10,000, registered with the Pontoise Trade and Companies Register under number 840 623 235, whose registered office is located at 12 Chaussée Jules César, 95520 Osny, France.

The Service is accessible through the Patissland website.

Article 2: Definitions

Artisan: any individual or legal entity professionally engaged in pastry, cake design, chocolate-making, confectionery, catering, training, or any other activity permitted by Patissland, and having or requesting the publication of a Listing on the Service. The term Artisan is used as a functional designation for listed professionals. It does not, in itself, constitute recognition by Patissland of any quality, title, qualification, or regulated status.

Client: any individual or legal entity that views the Service, searches for an Artisan, or sends them a request through the Service.

Content: any information, photograph, image, text, trade name, logo, indicative price, specialty, availability, or other element provided by an Artisan.

Quote Request: any request for information or contact sent by a Client to an Artisan through the Service.

Listing: the public page dedicated to an Artisan and containing all or part of the information and Content they have provided.

Artisan Area: the personal interface that enables the Artisan to manage their Listing.

User: any Client, Artisan, or visitor using the Service.

Article 3: Purpose of the Service

The Service notably enables:

  • for Artisans to present their business, location, specialties, work, availability, and certain commercial information;
  • for Clients to search for professionals according to various criteria;
  • for Clients to send contact or quote requests to selected Artisans;
  • to Patissland to publish, organize, categorize, moderate, and administer the Listings.

Patissland provides a professional directory service, content publication, and transmission of connection requests.

Patissland does not perform any pastry services on behalf of Artisans and does not participate in the negotiation, conclusion, or performance of any contracts that may be entered into between Clients and Artisans.

In the initial version of the Service, Patissland does not charge any commission on services entered into between Clients and Artisans.

Article 4: Acceptance and Enforceability of the Terms

An Artisan's registration and publication of their Listing are subject to express acceptance of these terms.

The Artisan accepts these terms by checking the box provided for this purpose during registration. This box is never preselected.

Patissland may retain proof of acceptance, including the version of the terms accepted, the date and time of acceptance, the Listing identifier, and the technical data necessary to establish such proof.

These terms are accessible before registration and throughout the entire period of use of the Service.

A Client's use of the Service constitutes acceptance of the provisions applicable to them.

Article 5: Registration Conditions for Artisans

Registration is reserved for professionals legally authorized to conduct their activity.

The Artisan must provide, in particular, their identity or professional name, their trade name where applicable, a valid email address, their professional location or area of operation, their SIRET number or any equivalent professional identifier in their country, the information requested in the registration form, and any additional supporting documents reasonably requested by Patissland.

The Artisan guarantees that the information provided is accurate, truthful, complete, and up to date.

The same person may not create multiple Listings intended to artificially represent the same activity, unless expressly agreed by Patissland.

Registration for the Service does not confer any automatic right to publication of a Listing. Patissland remains free to accept or refuse a registration request, particularly where the application is incomplete, the information is inconsistent or unverifiable, the activity does not correspond to the purpose of the Service, a previous Listing has been suspended or removed, publication would present a legal, health, commercial, or reputational risk, or the Service's technical or operational capacity does not permit registration.

Article 6: Verification of Listings

Before publication, Patissland may conduct a review of the form, consistency, and plausibility of the information provided, including the apparent existence of the business, the match between the professional identification number and the business, the consistency of the contact details, the general quality of the photographs, and the apparent compliance of the Content with these terms.

This verification does not constitute professional certification, approval, a health inspection, an accounting or tax audit, a guarantee of competence, solvency, or service quality, nor validation of the authenticity of all documents provided.

Unless expressly stated otherwise, the absence of a badge or verification notice does not mean that a Listing is non-compliant. When a specific badge is awarded, its scope and the corresponding checks are described by Patissland.

Article 7: General Obligations of the Artisan

The Artisan undertakes to:

  • carry out a legally registered professional activity;
  • comply with all legal and regulatory obligations applicable to their business;
  • in particular, comply with the rules applicable to food hygiene and safety, traceability, food preservation, allergen information, and labeling;
  • hold any authorizations, registrations, training, qualifications, and insurance that may be required depending on the nature of their business;
  • provide accurate information about their services, specialties, location, availability, and rates;
  • keep their Listing up to date, particularly their stated availability;
  • not present themselves under an identity, title, diploma, label, or status they do not hold;
  • respond professionally and fairly to requests received;
  • respect Clients' rights and the regulations applicable to commercial relations;
  • not use the Service for fraudulent, unlawful, or unrelated purposes.

The Artisan remains solely responsible for the legality of their business, products, commercial practices, and services.

Article 8: Commercial Information and Rates

The rates, price ranges, average budgets, or per-person prices published on a Listing are indicative, unless the Artisan expressly commits otherwise. The final price of a service must be agreed directly between the Client and the Artisan.

The Artisan is solely responsible for preparing their quotes, general terms and conditions of sale, deposits, cancellation policies, payment terms, issuing invoices, applying taxes and fulfilling tax obligations, as well as providing Clients with the required pre-contractual information.

Patissland does not guarantee that the published prices correspond to the final price charged.

Article 9: Requests for quotations and connecting the parties

The Service enables the Client to send a Request for a quotation to an Artisan. The request may include, in particular, the Client's identity and contact details, the proposed date, location, number of people, budget, type of event, project specifications and links to sources of inspiration.

Sending a Request for a quotation does not constitute an order, does not constitute a reservation, does not constitute acceptance of a quotation, does not oblige the Artisan to respond, does not guarantee the Artisan's availability and does not create any contract with Patissland.

No service contract is entered into through Patissland. Each contract is entered into directly between the Client and the Artisan on the terms they determine between themselves.

Patissland may retain a technical record of the transmission of the request to ensure the operation of the Service, prevent abuse, handle complaints and compile statistics.

Patissland may limit or block repetitive, fraudulent, automated, abusive, manifestly unserious or unrelated-to-the-Service requests.

Article 10: No liability for relations between Clients and Artisans

Patissland is neither a party, agent, representative nor guarantor of the Artisan or the Client in connection with contracts entered into between them.

Patissland does not participate in negotiating the price, approving the quotation, collecting the deposit or balance, manufacturing, storing, transporting, delivering, installing, cancelling, refunding, or handling complaints relating to the service.

Subject to mandatory legal provisions, Patissland cannot be held liable for:

  • the quality, conformity, taste, appearance or food safety of products made by an Artisan;
  • an error relating to allergens or the composition of a product;
  • failure to meet a deadline;
  • cancellation of an order;
  • failure to deliver;
  • non-payment;
  • damage caused by an Artisan or a Client;
  • a false statement made by a User;
  • poor performance or non-performance of a contract entered into between a Client and an Artisan.

Any dispute relating to a service must be handled directly between the Client and the Artisan concerned.

Article 11: Prevention of non-payment, cancellations and unserious requests

The Artisan remains solely responsible for securing their business relationship with the Client.

As a general recommendation, the Artisan may prepare a detailed quote, have it accepted before the service begins, request a deposit, define their cancellation terms in writing, verify the Client's contact details, specify the payment terms and deadlines, and retain relevant communications.

These recommendations do not constitute personalized legal advice and do not create any obligation for Patissland.

Patissland does not guarantee the Client's solvency or seriousness, does not carry out any collection, does not guarantee any payment, does not reimburse any unpaid amounts, and does not compensate for Clients' cancellations or no-shows.

Article 12: Publication and updating of Listings

The Artisan manages certain information from their Artisan Area. Depending on the nature of the field concerned, changes may be published immediately, be subject to prior verification, result in the temporary unpublication of the Listing, or be rejected by Patissland.

Content published immediately from the Artisan Area, including photographs of work, presentation texts, and availability, is published under the sole responsibility of the Artisan. Patissland does not carry out systematic prior checks of this content and acts afterward, particularly upon receiving a report.

Patissland may correct purely material or presentation errors, including typographical errors, display issues, excessive capitalization, duplicate content, the framing or format of photographs, and incorrect categorization.

Patissland does not substantially alter the meaning of professional information without informing the Artisan, except in cases of urgency, legal risk, or security requirements.

The Artisan must regularly update their availability and information. Patissland may display the date on which the Listing was last updated.

Article 13: Displayed location

The location of a Listing is determined based on the city and postal code provided by the Artisan. The geographic coordinates used for map display are approximate and correspond to the declared municipality, not to a precise address.

Patissland does not publish the workshop's exact address. The Artisan remains free to communicate their address directly to the Client during their exchanges.

Patissland does not guarantee the accuracy of the displayed location, particularly when the information provided by the Artisan is incomplete, incorrect, or ambiguous.

Article 14: Ranking and Display of Listings

Listings may be displayed or ranked according to several parameters, including the location searched, distance, selected specialities, declared availability, minimum order lead time, completeness of the Listing, quality and number of photographs, date of update, relevance to the Client's criteria, publication status and any technical criteria necessary for the proper operation of the Service.

The relative importance of these parameters may vary depending on the search performed and the evolution of the Service.

Patissland does not guarantee any ranking, level of visibility or volume of enquiries.

In the future, Patissland may offer promotional placements, featured Listings, enhanced visibility options or paid offers. Paid featured placements are appropriately identified when they influence the order in which Listings are displayed.

Patissland may also feature certain Listings on its own websites, newsletters, social media or communication media.

As of the date hereof, the Service does not include any rating or public review system. If such a system were introduced, its collection and verification procedures would be brought to the Users' attention.

Article 15: Ownership of the Content

The Artisan remains the owner of the rights they hold in the Content they provide.

The Artisan warrants that they are the author of the Content or hold all necessary authorisations, have obtained permission from any persons who may be identifiable, do not infringe the rights of a photographer, client, employee, service provider or third party, and do not use content obtained unlawfully from a competitor or another professional.

The Artisan shall indemnify Patissland against any third-party claim relating to the Content they have provided, subject to the applicable legal conditions.

Article 16: Licence Granted to Patissland

To enable the Service to operate, the Artisan grants Patissland, on a non-exclusive and royalty-free basis, the right to host the Content, reproduce it, represent it, publicly display it, compress it, resize it, crop it, adapt it to the Service's technical formats, associate it with the Listing information, index it in search engines, and present it on Patissland's communication media intended to promote the Service or the Listing.

This licence is granted worldwide and for the duration of publication of the Listing.

After the Listing is deleted, Patissland will cease any new promotional use of the Content within a reasonable period. Deletion cannot require the immediate removal of Content already printed, archived publications, technical backups, publications on third-party services whose removal Patissland cannot immediately control, or elements whose retention is necessary to establish evidence or defend Patissland’s rights.

The license does not entail any transfer of ownership to Patissland.

Article 17: Prohibited Content

It is prohibited to publish any false, misleading, or deceptive Content; insulting, defamatory, threatening, or discriminatory Content; obscene or violent Content; Content contrary to public order; Content that infringes privacy; Content that infringes a third party’s intellectual property rights; Content containing third parties’ personal data without authorization; Content promoting unlawful activity; Content likely to endanger people’s health or safety; Content containing malware, a fraudulent link, or a diversion scheme; or Content intended to artificially manipulate the ranking or visibility of Listings.

The Artisan must not publish, without authorization, protected representations of characters, trademarks, logos, works, photographs, sports teams, or elements belonging to third parties.

The fact that a cake or creation was made at a Client’s request does not necessarily authorize its public reproduction or commercial use on the Service.

Article 18: Moderation

Patissland may moderate Listings and Content before or after publication. In particular, Patissland may request additional information or supporting documents, temporarily hide Content, reject a photograph, correct the presentation of a Listing, limit certain features, lower a Listing’s ranking, suspend a Listing, delete a Listing, or prevent a new registration.

A measure may be taken in particular in the event of a false statement, inaccurate or outdated information, failure to hold professional status, suspected fraud, unlawful Content, infringement of a third party’s rights, a health or safety risk, a serious or repeated complaint, abusive behavior toward Clients or Patissland, use of the Service for purposes unrelated to its intended purpose, non-compliance with these terms, prolonged failure to update, or a risk to the operation or reputation of the Service.

Patissland may take immediate precautionary measures when keeping something online appears likely to infringe a third party’s rights, compromise User safety, violate regulations, affect the integrity of the Service, or harm Patissland’s legitimate reputation.

To the extent required by applicable regulations, the Artisan is informed of the reasons for the restriction, suspension, or removal on a durable medium. This information may be deferred or limited when it could violate a legal obligation, compromise an investigation, facilitate fraud, pose a security risk, or infringe the legitimate rights of a third party.

Article 19: Reporting Content

Any User or third party may report Content they believe to be unlawful or contrary to these terms. The report must be sent to info@patissland.fr.

To the extent possible, it must include the declarant's identity and contact details, the address or precise identification of the Profile, a description of the Content concerned, the reasons for the report, the information supporting its validity, any useful supporting documents, and a good-faith declaration.

An incomplete report may not enable Patissland to identify or assess the Content.

Patissland may acknowledge receipt of the report, request further information, forward all or part of the report to the Artisan, temporarily hide the Content, remove it, keep it available, restore it, or provide the required information to the competent authorities.

Patissland handles good-faith reports within a reasonable time, taking into account their nature, specificity, and the alleged risk.

Article 20: Personal Access for the Artisan

Access to the Artisan Area is provided through a personal link sent by email, a secure session, or any other method determined by Patissland. The access link is valid for a limited period and may be usable only once. The session opened on the Artisan's device also has a limited duration.

Access credentials are personal and confidential. The Artisan must not share or publish them, must prevent unauthorized third-party access, and must immediately inform Patissland in the event of loss, disclosure, or suspected use.

Any action carried out using valid access is presumed to have been performed by the Artisan, unless proven otherwise or a compromise was reported in advance.

Patissland may revoke access and generate a new one for security reasons.

The Artisan remains responsible for the security of their email account and devices.

Article 21: Welcome Offer and Promotional Operations

Patissland may offer certain Artisans, when validating their Profile, a personal discount code that can be used on the Patissland online store.

Unless otherwise stated when the code is communicated, it is strictly personal, may be used only once, is valid for the limited period indicated when it is assigned, cannot be combined with other promotional offers, is non-refundable, non-exchangeable, and has no cash value.

A welcome code is reserved for Artisans whose Listing has been effectively validated and published during the offer period. It does not constitute an acquired right or a commitment to renew it.

Patissland may cancel a code, refuse to apply it, or claim its equivalent value in the event of fraud, duplication of a Listing, false declaration, sharing of the code, an attempt to circumvent the offer's terms, or deletion of the Listing before use.

Use of the code in the online shop remains subject to Patissland's general terms and conditions of sale.

Article 22: Free Services and Future Services

As of the effective date of these terms, creating and publishing a standard Listing is offered free of charge.

This free provision does not constitute a commitment to remain permanently free of charge, create any acquired right to the continued availability of all features, or prevent Patissland from subsequently offering optional paid services.

Patissland may in particular offer enhanced visibility, subscriptions, professional tools, analytics, booking services, management features, advertising offers, or services charged per contact or transaction.

No amount will be charged retroactively. Activation of a paid offering will require clear prior information about its price, duration, renewal, features, and termination conditions. Where acceptance is legally required, the paid service will be activated only after a positive action by the Artisan.

Article 23: Changes to the Service and the Terms

Patissland may modify the Service, in particular to improve its operation, add or remove features, strengthen security, comply with a legal obligation, prevent abuse, or change its business model.

Purely technical or editorial changes, or changes without a significant adverse impact, may take effect upon publication.

Any substantial change to these terms that affects the rights or obligations of Artisans will be communicated on a durable medium within a reasonable period before it takes effect. Unless otherwise provided by regulations or required urgently, this period will be at least fifteen days. A longer period may be granted when the Artisan must make significant technical or commercial adaptations.

The time limit may not apply when an immediate change is required by law or an authority, an urgent measure is necessary to prevent fraud, a threat, or a security risk, the Artisan validly waives the time limit under the permitted conditions, or the change is exclusively favorable or has no significant adverse impact.

If they disagree with a substantial change, the Artisan may request deletion of their Listing before it takes effect.

Continued use of the Service after the new terms take effect constitutes acceptance, subject to cases in which express acceptance is legally required.

Article 24: Duration and Voluntary Removal

These terms apply throughout the entire period of publication or use of the Listing.

The Artisan may at any time request the temporary deactivation of their Listing, the deletion of their Listing, or the closure of their Artisan Area. The request must be sent to info@patissland.fr from the email address associated with the Listing, unless Patissland provides an alternative procedure.

Public deletion takes place within a reasonable period.

Certain data may be retained after deletion when necessary to comply with a legal obligation, prevent fraud, provide evidence of acceptance of the terms, manage a report, establish, exercise, or defend legal claims, or operate technical backups.

Article 25: Service Availability

Patissland uses reasonable means to ensure the availability and security of the Service.

The Service may nevertheless be temporarily unavailable, particularly due to maintenance, an update, a breakdown, a security incident, a service provider malfunction, a network interruption, force majeure, a decision by an authority, or an urgent technical change.

Patissland does not guarantee continuous availability, complete absence of errors, complete absence of data loss, permanent indexing by search engines, a minimum number of visitors, a minimum number of inquiries, or any particular level of revenue.

Patissland may suspend all or part of the Service for technical, legal, economic, or security reasons.

Article 26: Patissland's Liability

Patissland is responsible for the obligations directly incumbent upon it regarding the operation of the Service, within the limits provided by law.

Patissland cannot be held liable for information provided by an Artisan until it has actual knowledge of its manifestly unlawful nature or acts promptly after receiving a sufficiently precise report, under the conditions provided for by applicable regulations.

Patissland does not guarantee the permanent accuracy of the information provided by Artisans, the availability of an Artisan, the conclusion of a contract, the quality of a service, a User's solvency, the actual identity of a Client, or the absence of fraudulent conduct by a third party.

Subject to mandatory provisions, gross negligence, wilful misconduct, and liabilities that cannot legally be excluded, Patissland is not liable for indirect damages, including loss of revenue, loss of customers, loss of opportunity, indirect commercial harm, loss of data not attributable to a culpable breach by Patissland, or the consequences of a contract entered into between a Client and an Artisan.

Where Patissland is held liable to an Artisan for direct damage related to the Service, its total liability is limited, to the extent permitted by law, to the higher of the amounts actually paid by the Artisan to Patissland for the Service during the twelve months preceding the event giving rise to the liability and EUR 500.

Article 27: Artisan Liability

The Artisan is responsible for its business, statements, Content, use of its Artisan Area, the services it performs, its obligations toward its Clients, the damage it causes, and the lawfulness of its practices and communications.

The Artisan must indemnify Patissland against the direct consequences of a third-party claim based on a false statement by the Artisan, unlawful Content, infringement of intellectual property rights, a breach of a third party's personal data, a breach of the Artisan's professional obligations, or a service provided by the Artisan.

This obligation applies provided that Patissland informs the Artisan of the claim and allows the Artisan, to a reasonable extent, to submit observations.

Article 28: Personal Data

Patissland processes the personal data necessary for the operation of the Service. The processing may notably serve the purposes of managing registrations, verifying and publishing Listings, administering Artisan Areas, forwarding Quote Requests, communications relating to the Service, moderation, preventing fraud and abuse, securing the Service, managing reports, preserving evidence, producing statistics, and defending Patissland's rights.

The legal bases, data categories, recipients, retention periods, any transfers, and procedures for exercising rights are specified in Patissland's privacy policy.

The Artisan's private contact details, including their email address, telephone number, and professional identification number, are not made public, except where the Artisan expressly chooses to publish information for which publication is offered.

The data from a Quote Request is transmitted to the selected Artisan and to the technical service providers strictly necessary for the operation of the Service.

The Artisan receives the Client's data solely to respond to their request. The Artisan agrees not to use it for prospecting without an appropriate legal basis, resale, unauthorized disclosure, or any purpose unrelated to the request.

To exercise their rights, the User may write to info@patissland.fr.

Article 29: Cookies, statistics, and technical services

The Service may use technologies necessary for security, authentication, session retention, abuse prevention, the operation of forms, and the technical measurement of Service usage.

Where regulations require prior consent, the technologies concerned are activated only after that consent has been obtained.

The Service may use technical service providers, in particular for hosting, email delivery, data management, security, file storage, mapping, geocoding of locations, and form transmission. These providers are identified or described in the privacy policy where required.

Article 30: Force majeure

Neither party may be held liable for a failure resulting from an event reasonably beyond its control and displaying the characteristics of force majeure under French law.

This may include, where they meet the legal requirements, a widespread network outage, a major cyberattack, a natural disaster, a fire, an epidemic, an administrative decision, an external labor dispute, the interruption of an essential service provider, war, or civil unrest.

The concerned party shall inform the other party within a reasonable period where possible.

Article 31: Independence of the parties

Use of the Service does not create between Patissland and the Artisan any joint venture, employment contract, agency, commercial agency, relationship of subordination, exclusive representation, or franchise.

The Artisan carries out its business independently, freely sets its prices, and solely organizes its services.

Article 32: Entire agreement, partial invalidity, and waiver

These terms constitute the agreement governing use of the Service, subject to the documents to which they refer.

If any provision is declared null, illegal, or unenforceable, the other provisions shall remain in force.

Patissland's failure to exercise a right immediately shall not constitute a waiver of that right.

Article headings are used solely to facilitate reading.

Article 33: Evidence

Computer records, technical logs, emails, timestamps, validation histories, versions of the terms, and data recorded in Patissland's systems may be used as evidence, subject to applicable legal provisions and the ability to challenge their reliability.

Article 34: Complaints concerning the Service

Any complaint concerning the operation of the Service must be sent to PATISSLAND, Find an Artisan Service, 12 Chaussée Jules César, 95520 Osny, France, or by email to info@patissland.fr.

The complaint must specify the identity of the complainant, the relevant Listing, the subject of the complaint, the disputed facts, and the available supporting documents.

Patissland endeavors to respond within a reasonable period.

Article 35: Applicable law and competent jurisdiction

These terms are governed by French law.

Any dispute between Patissland and a consumer Client remains subject to the mandatory rules on jurisdiction and consumer protection.

Any dispute between Patissland and an Artisan acting as a trader, relating to the validity, interpretation, performance, or termination of these terms, shall fall under the exclusive jurisdiction of the Pontoise Commercial Court, including in the event of multiple defendants or third-party proceedings for indemnity, subject to the applicable mandatory rules.

Before initiating any proceedings, the parties shall endeavor to seek an amicable solution.

Key point. Patissland publishes and organizes the directory, forwards quote requests, and moderates content. Patissland does not sell or perform the services and does not guarantee their quality. Each contract is formed directly between the Client and the Artisan.
